Arbitration
Arbitration is essentially a streamlined trial conducted by one or three arbitrator(s). Unlike mediation, it is generally binding and parties must adhere to whatever decision the arbitrator(s) hands down. Arbitration can be handled by one person (arbitrator) or a panel. The use of arbitration is common in disputes over securities-related matters, broker disputes and especially construction disputes. Arbitration is governed by the parties' previous signed contracts. However, even if a contract does not have an arbitration clause, a case would likely still have to go through mediation.
Mediation
Mediation is different from arbitration because it is very different from trial. Mediations are nonbinding, which means parties do not have to adhere to a decision. Furthermore, a mediator is a neutral third party who is not there to hand down a decision but instead to listen to both sides and help facilitate a solution. Mediations are completely confidential and anything disclosed during the mediation cannot be later disclosed at trial.
